1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Krung Capital" / "we" / "us" / "our" refers to the financial education organisation operating from 41 Petchkasem Road, Hua Hin, Prachuap Khiri Khan 77110, Thailand.
- "Programme" refers to any of the financial education sessions offered by Krung Capital, including the Newcomer's Guide to Investing, the Estate and Will Considerations workshop, and the Household Investment Policy Statement programme.
- "Participant" / "you" refers to any individual who books or attends a Programme.
- "Materials" refers to printed documents, templates, reading lists, and other materials provided during a Programme.
- "Website" refers to the website operated by Krung Capital at krungcapq.info.
- "Agreement" refers to these Terms and Conditions, which form the basis of the relationship between Krung Capital and any Participant.
2. Acceptance of Terms
By submitting an enquiry through our website, booking a place on a Programme, or attending a Programme, you agree to be bound by these Terms and Conditions. If you do not agree, you should not submit an enquiry or book a place.
Our Programmes are intended for adults aged 18 and above. By booking, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement.
3. Service Description
Krung Capital provides financial education programmes for adults. Our programmes are designed to improve financial literacy and understanding. They are educational in nature and do not constitute financial advice, investment advice, legal advice, or any other form of regulated professional service.
Programmes are delivered in person at our premises in Hua Hin, Thailand. Availability of sessions is subject to minimum group sizes and scheduling. We reserve the right to reschedule or cancel a session where the minimum number of participants has not been reached, with reasonable notice provided to registered participants.
4. Enrolment and Booking
A place on a Programme is confirmed upon receipt of full payment and a booking confirmation from Krung Capital. Submitting an enquiry does not constitute a booking.
We aim to acknowledge all booking enquiries within two business days and to confirm a place within five business days, subject to availability.
5. Payment Terms
Programme fees are as follows, quoted in Thai Baht (THB) per person:
- Newcomer's Guide to Investing: 5,300 THB
- Estate and Will Considerations in Thailand: 8,900 THB
- Household Investment Policy Statement: 11,400 THB
All fees include printed materials provided during the Programme. Payment details will be provided upon confirmation of your booking. Payment is due in full prior to the commencement of the first session.
Cancellation by participant: If you cancel a booking more than seven calendar days before the first session of the Programme, we will refund your payment in full. If you cancel seven or fewer days before the first session, the fee is non-refundable, except where we are unable to provide the Programme due to circumstances within our control, in which case a full refund will be issued.
Cancellation by Krung Capital: If we cancel or reschedule a session, we will provide as much notice as reasonably practicable. Participants affected by a cancellation will be offered an alternative date or a full refund.
6. Participant Responsibilities
Participants are expected to attend sessions punctually and to conduct themselves respectfully toward facilitators and other participants. Krung Capital reserves the right to remove from a Programme any participant whose conduct is disruptive or disrespectful, without refund.
Participants must not record sessions by audio, video, or any other means without the prior written consent of Krung Capital and any other participants present.
Any financial information shared by a participant during a session is done voluntarily. Participants are not obliged to share personal financial details at any point.
7. Intellectual Property
All curriculum content, printed materials, templates, and website content are the intellectual property of Krung Capital or its licensors. Participants are granted a personal, non-exclusive licence to use printed materials for their own private, non-commercial purposes.
Participants may not reproduce, distribute, or publicly share Programme materials without the prior written consent of Krung Capital.
8. Disclaimers
Krung Capital's Programmes are educational only. Nothing presented in a Programme, on our website, or in our printed materials constitutes financial advice, investment advice, legal advice, tax advice, or any other form of regulated professional advice.
Participants who need advice on specific financial, legal, or tax matters are encouraged to seek independent qualified professional guidance. Facilitators will indicate clearly when a question falls outside the scope of background education.
While we take care to ensure the accuracy of programme content, we cannot warrant that all information is complete, current, or applicable to every individual's circumstances. Programmes are provided for general educational purposes only.
9. Limitation of Liability
To the extent permitted by applicable law, Krung Capital's total liability to a participant arising from or in connection with a Programme shall not exceed the amount paid by that participant for the Programme in question.
We shall not be liable for any indirect, consequential, or incidental loss, including loss of profit, loss of savings, or financial decisions made by a participant following attendance at a Programme.
Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
10. Termination
Either party may terminate a booking agreement by written notice. Cancellation by the participant is subject to the refund terms set out in Section 5. Termination does not affect any rights or obligations that have already accrued.
11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Thailand. In the event of a dispute, both parties agree to first attempt resolution through direct negotiation. If informal resolution is not possible within 30 days, disputes shall be subject to the jurisdiction of the Thai courts.
Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
12. General Provisions
Entire agreement: These Terms and Conditions constitute the entire agreement between Krung Capital and the participant in relation to a Programme booking.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in the future.
Assignment: Participants may not transfer or assign their booking to another person without our prior written consent.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. The version in effect at the time of your booking applies to that booking. We will publish updated terms on this page and revise the "Last updated" date accordingly.
